Conditions of participation

• The competition is carried out on the basis of these conditions of participation.

• By participating in the competition, the participant agrees to the contents of these conditions of participation.

• All questions, comments or complaints regarding the competition should be sent by e-mail to Bense & Eicke. The e-mail address is: info@bense-eicke.de.

• The organizer of the sweepstakes is not Facebook or Instagram, but Bense & Eicke. Bense & Eicke is responsible for the organization, processing and prize provision. Bense & Eicke reserves the right to cancel or terminate the competition at any time. Bense & Eicke will make use of this option in particular if due to technical errors, manipulations or legal reasons a proper execution of the competition can no longer be guaranteed.


1. The prizes

• The prizes will be displayed on our Instagram/Facebook pages respectively.

• Only one prize is possible per participant in the Bense & Eicke sweepstakes.

• Cash payment, transfer or exchange of non-cash prizes is not possible.

• The prize will be sent by post or can be collected by the organizer in 37574 Einbeck-Edemissen.


2. Conditions of participation, disqualification

• All natural persons residing in Germany, Austria or Switzerland who have a valid postal address and are at least 16 years old are eligible to participate.

• Participants in the competition must have an internet connection, a Facebook account or an Instagram account and an e-mail address.

• Participation in the prize is only possible in person, substitution is excluded.

• Legal representatives and employees of Bense & Eicke are excluded from participation. Furthermore, all persons and partners involved in the implementation of the competition and also the family members of the aforementioned persons are also excluded from the competition.

• To participate in the competition, it is absolutely necessary that all personal details are true, otherwise the participant may be excluded from the competition. Providing false personal data will result in disqualification.

• Participation via automatic robots or other manipulations are not permitted and a violation may result in disqualification from participation.

• You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated or any other unlawful material. Such contributions will be excluded from the contest.


3. How participants can take part in the competition on Facebook

Participation in the competition is usually done by liking the post - deviations are in the respective posts. The instructions in the competition posts apply.


4. Prize determination

The prize is determined by the organizer by drawing lots at random.


5. Rights of use, indemnification and responsibility

• The organizer is not obliged to check the content provided by the participants (for example pictures) for potential infringements of the rights of third parties. However, the organizer is entitled to reject content if it is illegal or contrary to public decency according to his proper assessment.

• By uploading content, in particular images, participants declare that the content is free of third-party rights, i.e. that the content either originates from them or that they have obtained the consent of the authors as well as the persons depicted in the images.

• The participants indemnify the organizer against all claims of third parties that have arisen due to the content provided to the participants. They agree to support the organizer in every reasonable way in defending these claims.

• The participants agree that their submissions in connection with the competition and the drawing, processing and presentation of the participants' entries may be used, disseminated and otherwise made publicly accessible by the organizer in online and offline media (e.g. in print). For these purposes, the organizer is also permitted to process the entries and - if necessary - to grant third parties rights of use to them. This granting of rights shall be free of charge and without any restriction in terms of space, content or time.


6. Duration

The start and end of the competition will be announced on the Facebook or Instagram page of the organizer.


7. Notification of the winner

• The winner will be notified via Facebook or Instagram page comment function and requested to send an e-mail to an e-mail address specified there, in which the name and postal address are transmitted properly and truthfully in full. This information is used to send the prize.

• The prize will be notified immediately after the end of the competition.

• If the winner does not respond to the prize notification within 3 working days, the claim to the prize will be forfeited and a new winner will be drawn. If the contact details provided are incorrect, the organizer is not obliged to find the correct addresses; any disadvantages resulting from the provision of incorrect contact details shall be borne by the participant concerned.


8. Termination of the competition

Bense & Eicke reserves the right to cancel or terminate the competition at any time without prior notice and without giving reasons. Bense & Eicke will make use of this option in particular if for technical reasons, e.g. (viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, proper execution of the game cannot be guaranteed. If such termination is caused by the conduct of a participant, Bense & Eicke may claim compensation from such person for any damage suffered.


9. Data protection

• The organizer is responsible under data protection law for the processing of the personal data of the participants for the purpose of organizing the lottery. By participating in the sweepstakes, the participant gives consent pursuant to Art. 6 (1) lit. a DSGVO that his/her specified data will be processed for the purpose of organizing the sweepstakes. In the event of a win, the name and postal address of the participant is required for this purpose. The participant transmits these via direct message on Facebook.

• The participant is free at any time to revoke the consent by revocation and thereby withdraw from the participation. In the event of revocation, Bense & Eicke will immediately delete the data concerned. The revocation of the consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

The applicable data protection law grants participants comprehensive data subject rights (rights of information and intervention) vis-à-vis the organizer with regard to the processing of their personal data, namely:

• Right to information pursuant to Art. 15 DSGVO;

• Right to rectification pursuant to Art. 16 DSGVO;

• Right to erasure pursuant to Art. 17 DSGVO;

• Right to restriction of processing pursuant to Art. 18 DSGVO;

• Right to information pursuant to Art. 19 DSGVO;

• Right to data portability pursuant to Art. 20 DSGVO;

• Right to withdraw consent given pursuant to Art. 7(3) DSGVO;

• Right to lodge a complaint pursuant to Art. 77 DSGVO.

• The personal data of the participants will be used and stored exclusively for the implementation and processing of the competition and for possible contact in the event of a win. Personal data will not be disclosed to third parties (except for the delivery of the prize - to third parties (e.g. post office, parcel service).

• After the end of the competition and complete processing of the competition, all stored data will be deleted.

10. Liability

• The sweepstakes of Bense & Eicke are not connected to Facebook or Instagram and are in no way sponsored, supported or organized by Facebook or Instagram. The recipient of the information provided by participants is not Facebook or Instagram, but Bense & Eicke. Please direct any questions, comments or complaints regarding this sweepstakes exclusively to Bense & Eicke. Participants cannot make any claims via Facebook or Instagram that are related to participation in the sweepstakes.

• Bense & Eicke is not liable for false information caused and disseminated by participants and/or third parties in connection with the sending of information about the sweepstakes.

• Bense & Eicke shall not be liable for any technical or other problems beyond the control of Bense & Eicke, Facebook or Instagram that result in an interruption of the Sweepstakes. If an interruption occurs, the companies involved will make every effort to remedy it as quickly as possible.

• The legal process is excluded.


11. Miscellaneous

• The sole applicable law is the law of the Federal Republic of Germany.

• These conditions of participation, including the sweepstakes mechanics, represent the final regulations for the sweepstakes.
